Terms of Service

1. About Color By Day

Color By Day ("we," "us," "our") provides a print fulfillment platform: artists and shop owners ("sellers") submit artwork and print orders through our platform, and we print, pack, and ship those orders directly to their customers ("buyers"). By creating an account or placing an order, you agree to these Terms.

2. Accounts

You're responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when creating an account and keep it up to date.

3. Orders and payment

Prices for prints, paper, framing, and shipping are shown at the time of order. Payment is processed through Stripe at the time an order is placed. Once an order has entered production, it generally cannot be canceled or modified.

We reserve the right to decline or cancel any order, including for suspected fraud or artwork that violates these Terms.

4. Print quality and reprints

We stand behind the quality of our printing. If a print arrives damaged or defective due to an error on our part, we'll reprint and reship it at no additional charge if you contact us within 7 days of delivery. We are not responsible for quality issues caused by low-resolution or improperly prepared source artwork.

5. Shipping

Shipping costs and delivery estimates are calculated at checkout using real-time carrier rates. We are not responsible for delays caused by the shipping carrier once a package has been handed off for delivery.

6. Your artwork

You retain full ownership of any artwork you upload. By submitting artwork for printing, you confirm that you own it or have the right to reproduce it, and you grant us a limited license to reproduce, print, and ship it solely for the purpose of fulfilling your order. You agree not to submit artwork that infringes on someone else's copyright, trademark, or other rights.

7. Connected sales channels

If you connect a third-party sales channel (such as Etsy) to your account, you authorize us to access order and shop information from that channel as needed to import and fulfill orders on your behalf. Your use of that channel remains subject to its own terms of service.

8. Acceptable use

You agree not to use the platform for any unlawful purpose, to submit artwork that is illegal or infringing, or to attempt to disrupt or gain unauthorized access to our systems.

9. Limitation of liability

To the fullest extent permitted by law, Color By Day is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any order is limited to the amount you paid for that order.

10. Termination

You may close your account at any time. We may suspend or terminate an account that violates these Terms.

11. Changes to these terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the platform after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of North Carolina, USA.
